Switching Providers (EU Data Act)
Zesty supports customer rights under the EU Data Act, including the ability to switch to another provider.
This page explains how switching works, what data is included, and how to submit a request.
Overview
Zesty is designed so that your raw data always remains in your own environment.
No data is stored or locked within Zesty systems
No export or transfer process is required to access your raw data
You retain continuous, direct access to your data at all times
Because of this architecture, switching providers is primarily a configuration and operational process, not a data migration.
What happens when you switch
When you decide to switch:
You continue accessing your existing data directly from your cloud environment
Zesty provides guidance and documentation to support the transition
The service continues during the transition period (subject to your agreement terms)
If needed, Zesty can provide reasonable assistance to support the switching process.
What data can be switched
Under the EU Data Act, you may request access to and migration of Exportable Data, which generally includes:
Customer data and assets processed as part of the service
Data that does not include Zesty intellectual property or proprietary elements
What data is not included
The following are not transferable:
Zesty-generated insights, recommendations, predictions, or analytics
Any data containing Zesty intellectual property or trade secrets
Platform usage data or internal service data
Certain technical or supporting materials (e.g., manuals, invoices)
How to submit a switching request
To initiate switching:
Submit a Switching Request to: support@zesty.co
Provide:
Your account and contact details
Target provider or on-premise destination
Technical specifications (if applicable)
Scope of requested data
A standard notice period of 2 months applies.
Switching timeline
Request submitted - Customer sends Switching Request in accordance with the EU Data Act Addendum
Notice period (2 months) - Transition planning and execution
Switching completion - Customer validates successful transition
Optional retrieval period (up to 30 days) - Temporary data retention if requested
Customer responsibilities
Ensure you have the rights to request switching of the relevant data
Handle data import into the new provider or environment
Validate that switching was successfully completed
Fees and commercial considerations
Switching assistance may be subject to service fees (if applicable)
Existing subscription commitments may still apply, including early termination fees
Standard subscription charges continue during the transition period
